This cause comes before us upon a writ of error to the circuit' court for the district of Columbia, sitting in Alexandria.
The original suit is an action of covenant brought by Scott, as assignee, to recover the amount of certain rents alleged to be due and in arrear from the defendant, since the death of his intestate, under ap indenture stated in the pleadings. The defendant pleaded in- the first place, that he had not broken the covenants in the deed; after which plea, issue was joined.
