MITCHELL, Judge.
The State has brought this appeal from an order finding Chapter 269 of the 1975 North Carolina Session Laws unconstitutional. The defendant, Gary Dewayne Stewart, was charged by citation with deliberately displaying an artificial light from a motor-driven conveyance into a field frequented by wild deer and beyond the surface of a roadway between the hours of 11:00 p.m. and one-half hour before sunrise in violation of Chapter 269 of the 1975 North Carolina Session Laws.
