Sims, J.,

after making the foregoing statement, delivered the following opinion of the court.

The assignments of error raise but two questions for our consideration, which will be hereinafter stated and decided.

As appears from the above statement this is a case in which the Commonwealth acquired a valid title to the lot in question at a sale of it for delinquent taxes at which it was bought by the Commonwealth. No question arises as between the Commonwealth and the former owner of the lot, or appellee claiming under the latter by mesne conveyances, on that subject. We set out, therefore, upon…
