J. M. Haynes, the defendant in error, on May 31st, 1889, instituted his suit in assumpsit in the Circuit Court of St. Johns county, in the Fourth Judicial Cir*620cuit of Florida, against Edward C. F. Sanchez, the plaintiff in error, who then resided, as the praecipe for .summons in the cause recites, at Gfainesville, in Alachua -county, in the Fifth Judicial Circuit of Florida.
