This action was to quiet title to a strip of land in the county of Merced. The strip of land in dispute was the west thirteen and a half chains of sections 30 and 31 in a certain township. The land was swamp and overflowed land, and title thereto was vested in the state under the Swamp Land Act. Plaintiff claimed title under a patent issued to him by the state in December, 1873, while defendant's claim is based upon a certificate of purchase dated in 1887.
