The demurrer to the indictment was not well taken. Appellant cites the case from this court of Hill v. State, 22 Ala. App. 422, 116 So. 411, to sustain him in his insistence in this connection. The Hill Case, supra, as reported, is inadvertent on the point in question and to that extent is overruled. Haithcock v. State (Ala. App.) 126 So. 890. In the instant case the demurrers were properly overruled; the form and substance of the indictment here has many times had the approval of the appellate courts of this state.
