Grice, Justice.

The dismissal of an appeal in which the transcript was not filed in the trial court within 30 days after filing of the notice of appeal is for review here. From two adverse judgments in the Superior Court of Fulton County, E. S. Elliott had appealed to the Court of Appeals. That court, in a five to four decision, dismissed his appeal (Elliott v. Leathers, 115 Ga. *498App. 352 (154 SE2d 694)), and we granted his application for certiorari.
