OPINION AND ORDER DENYING CROSS-PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

LAWSON, District Judge.

This case was commenced as an inter-pleader action by Metropolitan Life Insurance Company (MetLife), the stakeholder of a death benefit from a policy of insurance on the life of Daniel Awad. Mr. Awad died in April 2000, and his former wife, Holly Lynn Awad, and his two children by a prior marriage, Christine L. Mulligan and Brenda M.
