OPINION
WALKER, Presiding Judge.
At the January term, 1968, the Davidson County Grand Jury jointly indicted the de*520fendants below, John Henry Gant and Frank Holiday, for murder in the first degree of Antoinette Utley and in a second count indicted Gant as an accessory before the fact of murder in the first degree. From their convictions under the first count of murder in the first degree and sentences to life imprisonment, they have appealed to this court.
