MEMORANDUM AND ORDER
WALINSKI, District Judge.
This cause is before the Court on defendants’ motions to dismiss the complaint for lack of subject matter jurisdiction and for failure to state a claim on which relief can be granted, and to dismiss the class action aspects of the complaint. Plaintiff has filed a motion for conditional certification as a class action and opposition to defendants’ various motions. Plaintiff has also filed copious briefs in support of his contentions.
