In an action commenced as one for divorce but tried, pursuant to an amendment of the complaint at trial, as one for a decree of support and for a judgment for moneys previously expended for necessaries, the plaintiff appeals from an order of the Supreme Court, Kings County, dated January 22, 1979, which dismissed the complaint, as amended, on the merits and denied the plaintiff an award of counsel fees.
