This was an action by Harry Homewood against the Atchison, Topeka & Santa Fe Railway Company and the Gulf, Colorado and Santa Fe Railway Company to recover damages for the loss of a certain car, called “Gertrude,” together with its contents. The plaintiff, Harry Homewood, was engaged in the management of a certain minstrel show, and sometime in November, 1907, he entered into' contracts to present the show at Tecumseh and other places in the state of Oklahoma.
