OPINION AND ORDER ON MOTIONS FOR SUMMARY JUDGMENT

I. Preliminary Considerations
The defendant in this adversary proceeding, Society Bank & Trust (“Society”), has moved for summary judgment on its affirmative defense. The plaintiff, Nora E. Jones, trustee of the Chapter 7 bankruptcy estate of Paul and Lisa Riggs (“Trustee”), opposes that motion and has cross moved for summary judgment. All responsive pleadings have been filed and the matter is now before the Court for decision.
The Court has jurisdiction in this adversary proceeding under 28 U.S.C. § 1334.…
