The defendant appeals from a judgment in an action under § 63 of Title 35, U.S. C.A. awarding to the plaintiff priority in the invention of an improved electric cigar lighter. The action was begun on February 16, 1942, to review two orders of the Board of Appeals of the Patent Office, one entered on January 21, 1942, and the other on September 8, 1941, each affirming an award by the Board of Interference Examiners to the defendant of the invention in suit.
