Meredith, Judge:

Defendant seeks to reverse the judgment of the circuit court of Mercer County, by which he was sentenced to confinement in the penitentiary for five years on the charge of forgery.

The indictment charges, and the evidence introduced for the state tends to show, that during the month of May, 1919, defendant presented for payment at the First National Bank of Bluefield a check for $92.00, purporting to be signed by Wright Smith as maker, payable to the order of Joe Johnson, and bearing the notation “for liberty bond.” According to the testimony of the bank teller, defendant…
