These causes, which are alike, were tried at a special term of the supreme court, without jury, and the complaint in each was dismissed. The judgments were affirmed at the general term, and the plaintiffs appeal to this court. For the purpose of review the cases were made in the following manner: In the first place, the evidence, which is voluminous, embracing a variety of schedules and facts and matters in detail, is inserted.
