HUNTER, Judge.

Robert Michael Stuart Luther and James Leonard Reese, II (“plaintiffs”) appeal from orders granting summary judgment to Herman C. Seawell and North Carolina Farm Bureau Mutual Insurance Company (collectively “defendants”). After careful review, we dismiss in part and affirm in part.

On 23 April 2001, plaintiffs submitted an application for homeowner’s insurance to defendant Farm Bureau; this application was physically filled out by defendant Seawell, with whom plaintiffs had previously met to provide the information necessary for the application.
