After the reinstatement by the Court of Appeals of the indictment charging the defendant with the crime of perjury (305 N. Y. 793), it appears that additional evidence was submitted to the Extraordinary Grand Jury of the County of Saratoga and an additional indictment was found against the defendant on September 8, 1953, charging him with the crime of conspiracy, in violation of section 580 of the Penal Law.
