The plaintiff, appellant herein, instituted this action in the Court of Common Pleas of Hamilton county on August 4, 1938, to recover damages on account of personal injuries she alleged she received on the 11th day of September, 1937, through the negligence of the defendant. At that time the defendant was a minor, and did not become 21 years of age until the 19th day of August, 1939, but no mention of this fact was made in the petition. A summons was served upon him as though he were an adult on the 5th day of August, 1938.
