This is a guardianship case. The State of Arkansas appeals a probate court decision that the guardian of the ward’s estate may not use money represented by a certificate of deposit (CD) owned by the ward to reimburse medicaid payments which had been made and were to be made for the ward’s care. The first issue presented is whether there was subject matter jurisdiction in the probate court to determine how the principal of the CD was to be used.
