MEMORANDUM

YOUNG, District Judge.

I. INTRODUCTION

This matter arises from a subpoena served upon attorney Stuart Cable (“Cable”) seeking information related to public statements he made in an IPO Journal article. The information was sought by the plaintiffs in an antitrust action (“the antitrust plaintiffs”) pending in the Southern District of New York. Cable moved to quash the subpoena, arguing, inter alia, that it sought his testimony as an unretained expert.
