FRASER, Justice.

This is an appeal from a summary judgment granted by the District Court of Andrews County, Texas. The law suit resulted from an automobile collision, and was brought by J. C. Box against Don Bates and R. F. Bates. The defendants answered and, subsequently thereto, filed their motion for summary judgment, in which they alleged that there were three cars involved, the third car being under the control of one H.
