MILLER, District Judge.

The plaintiff Wood Preserving Corporation seeks by this action to set aside the order of the Deputy Commissioner of the United States Employees’ Compensation Commission entered on January 18, 1940, awarding Robert L. Youngblood compensation for total and permanent disability caused by an injury on May 20, 1938, while in the employ of the plaintiff and engaged in repairing a barge floating in the Ohio River. The award was made under the provisions of the Longshoremen’s and Harbor Workers’ Compensation Act of 1927. 33 U.S.C.A. §§ 902-950. The present proceeding to set…
