— This was a proceeding for the location, opening and establishment of a new public highway, commencing one mile north of the town of Wingate, in Montgomery county, Indiana, and running east a distance of two miles across sections 11 and 12, connecting two existing highways which run at right angles with it. The petition properly alleged the necessary jurisdictional facts.
