Appeal from a judgment of the Superior Court of the city and county of San Francisco, and from an order refusing a new trial. Upon the trial, a witness for the prosecution, Chow Hin, was asked on cross-examination by the defendant if he did not testify to certain things in the police court; and on re-examination the prosecuting attorney presented and read to the witness his written deposition given in the police court, and asked him if he did not so testify there, the evidence being substantially the same as that given by the witness upon the present trial. The appellant was charged, tried, and convicted of the crime of murder in the first degree, and sentenced to death. He moved the court below for a new trial, which was denied, and now prosecutes this appeal.
