In an action to recover damages for breach of contract, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Murphy, J.), dated February 1, 2016, as granted the defendant’s motion pursuant to CPLR 5015 to vacate a clerk’s judgment entered August 27, 2013, in its favor in the sum of $30,672.55, upon the defendant’s failure to comply with a stipulation of settlement dated June 27, 2012, and sua sponte, in effect, directed specific performance of the stipulation of settlement.
