MORROW, Presiding Judge —

Murder is the offense; punishment fixed at confinement in the penitentiary for a period of twenty-five years.

A motion to dismiss the appeal is made by the state. It appears that the appellant, on the 14th day of October, 1926, was convicted in the District Court of Hunt County, Texas, of the offense of murder, and his punishment fixed at confinement in the penitentiary for a period of twenty-five years.
