Appeal by defendant from a judgment of the County Court, Rockland County (Edelstein, J.), rendered April 12, 1984, convicting him of assault in the second degree (two counts), and assault in the third degree, after a nonjury trial, and imposing sentence.

Judgment affirmed, and case remitted to the County Court, Rockland County, for further proceedings pursuant to CPL 460.50 (5).
