On August 13, 1939, Herman Oldemeyer, the defendant-appellant was the operator of a garage and filling station located in Sioux City, Iowa. The garage is a one story building and is about 125 feet long and 75 feet wide. There was room for 75 or 80 cars in the part used for the storage of cars, and at the time of the alleged negligence of defendant’s employee there were approximately four or five cars in the garage.
