The defendant was tried and convicted of the crime of murder at the July term, 1905, of the Court of General Sessions of Sumter County. After he was sentenced, he appealed to> this Court upon seven grounds. From1 the record it appears that the appellant stabbed, to' death, Capt. D. K. Wells, by the use of a knife upon his neck, throat and back, inflicting eight wounds from which he instantly died.
