Appeal from a judgment of the superior court for King county, Albertson, J., entered December 12, 1911, in favor of the defendants, upon sustaining a demurrer to the complaint.

Respondent moves to dismiss the appeal upon the ground of lack of jurisdiction in this court, the jurisdictional defect being that the amount originally involved is less than $200. The facts, .in so far as they may be considered upon this motion, are these: In September, 1911, James Peterson brought an action against M. Leites, before a justice of the peace at Seattle, in which he recovered judg*475ment for $99.99 and costs.
