The parties to this action were married in New York in 1929 but have lived separate and apart since 1934. Six years after they parted the wife obtained a decree of separate maintenance in New York by reason of respondent’s desertion and wilful neglect. By the judgment the husband was ordered to pay $40 per week for the wife’s support. After years had elapsed during which the husband did not make the payments required of him by the New York judgment, the wife instituted this action to recover the unpaid amounts that had accrued.
