Order, same court and Justice, entered October 20, 1995, which dismissed the indictment charging defendant with one count each of criminal possession of a controlled substance in the first degree and criminal possession of a controlled substance in the third degree, unanimously reversed, on the law, the indictment reinstated and the matter remanded for further proceedings.
