Plaintiff brought this action to recover damages for personal injuries claimed to have been sustained while he was unloading a truck load of grain at the defendant’s elevator at Dwight, North Dakota. The case was tried to a jury and resulted in a verdict in favor of the plaintiff. The defendant moved in the alternative for judgment notwithstanding the verdict or for a new trial. The motion was denied and defendant has appealed from the judgment and from the order denying its motion for judgment notwithstanding the verdict or for a new trial.
