On June 26, 1928, G-eorge W. Anderson leased certain premises in Oakland, California, to John Brett and Gr. Kelly, for a period of five years, from July 15, 1928, at a monthly rental of $150 per month. The lease was in writing. At the time of the execution of the lease the lessees paid to the lessor the sum of $450, $800 of which was' to apply on the last two months’ rental and the balance of $150 to apply on the first month’s rental.
