This was an action to recover rents for a building rented to defendant by plaintiff’s intestate. The Court erred in refusing to charge, when requested, “that the defendant can not deny the title of the plaintiff.” The defendant took possession as tenant of W. A. Greenleaf, 2d December, 1892, and net having surrendered possession to said Greenieaf or his admitted agent, Mrs. H. T. Greenieaf, nor to the plaintiff, he can not be heard to deny that title, during the existence of his tenancy of the property which continued till 19th May, 1899, shortly before the beginning of this action.
