In a proceeding pursuant to article 78 of the CPLR to compel respondent Lavine to assign counsel to' petitioner, without cost to petitioner, upon a statutory fair hearing with respect to a proposed discontinuance or suspension of public assistance to petitioner, the appeal is from a judgment of the Supreme Court, Queens County, dated July 5, 1973, which denied the application. Judgment affirmed, without costs. No opinion. Latham, Cohalan, Brennan and Munder, JJ., concur; Hopkins, Acting P.
