In this appeal, the question presented is whether an agreement entitled “Covenant Not to Sue” between a plaintiff, who sought damages in the trial court for alleged personal injuries, and certain defendants, released all other defendants as joint tort-feasors. G. C. Murphy Company, a defendant not a party to the agreement, filed a motion for summary judgment on the ground that the agreement was in effect a release which discharged Murphy and all the other joint tort-feasors from liability.
