WISDOM, Circuit Judge:
This appeal is from a judgment of the district court granting an involuntary dismissal of United States Steel’s claim for damages, under the Taft-Hartley Act, § 301(a), 29 U.S.C. § 185(a) (1970), against the United Mine Workers of America, UMW District 20, and UMW Local 8982. The case illustrates the increasing tendency of miners to strike in violation of the no-strike clause implied as a result of an express arbitration clause in the National Bituminous Coal Wage Agreement of 1971.
