THEIS, District Judge.
Richard Lee Davis, the plaintiff herein, and formerly an inmate of the United States Penitentiary at Leavenworth, Kansas, has filed this action seeking compensatory relief under 18 U.S.C. § 4126 for injuries allegedly suffered as a consequence of his employment within the federal. prison hospital. In previous opinions in this litiga tion this Court determined that the decision in United States v. Demko, 385 U.S. 149, 87 S.Ct. 382, 17 L.Ed.2d 258 (1966), precluded it from awarding damages as requested in the complaint, but that jurisdiction…
