This action was brought to enforce the specific performance of an alleged oral contract whereby the defendant G. Gilbertson, hereafter-referred to as the defendant, agreed to convey certain land in the *67county of Norman to the plaintiff.' The cause was tried by the court without a jury, and findings of fact in favor of the plaintiff made, and judgment ordered in his favor for the relief demanded in the complaint, and the defendant appealed.
