James W. Bainbrich and R. Ebler, plaintiffs in error, were plaintiffs in the district court, and Eyer Boies, defendant in error, was defendant in the district court. The parties hereto will hereinafter be referred to as plaintiffs and defendant as that position was taken by them in the district court.
