In a proceeding pursuant to CPLR article 78 to review a determination of the respondent Board of Education of the City of New York, dated January 22, 1991, which denied the petitioner reinstatement to his permanent civil service position of Civil Engineer, the petitioner appeals from a judgment of the Supreme Court, Kings County (Bernstein, J.), entered September 10, 1991, which denied the petition and dismissed the proceeding.
