Brown appeals following the trial court’s grant of new trial on its own motion.

1. Appellant contends that the trial court erred in denying his motion for a directed verdict at the close of the plaintiffs case. This *404case previously appeared in this court for a review of the trial court’s grant of a motion for summary judgment in favor of appellees and this court reversed finding issues of fact requiring jury resolution.
