CANNELLA, District Judge.

The motion by Public Service Mutual Insurance Company pursuant to Rule 46(f) of the Federal Rules of Criminal Procedure for an order remitting the forfeiture of a bail bond in the above named action is granted, in part.

The defendant, who was free on $10,-000 bail, failed to appear for the start of his trial on April 16, 1968, and a bench warrant was issued for his arrest. The surety was given a reasonable opportunity to find the defendant. On May 3, 1968, he was still a fugitive, and the government moved that bail be forfeited. Judge Pollack adjourned the matter,…
