This action was brought in the court below by the defendant in error against the plaintiff in error. The former will be referred to as the “defendant,” and the latter as the “plaintiff.” The suit is under the Federal Employers’ Liability Act (chapter 149, 35 Stat. 65 [U. S. Comp. St. Supp. 1911, p. 1322]), for personal injuries alleged to have been received by the plaintiff by the negligence of the defendant.
