OPINION

COLE, Circuit Judge.

Ladarryl Kimble appeals his sentence resulting from a judgment of criminal contempt that arose out of his refusal to testify at the criminal trial of two defendants. Kimble argues that the district court improperly applied a United States Sentencing Guidelines (“U.S.S.G.” or “Guidelines”) cross-reference provision in the calculation of his sentence, resulting in a much lengthier sentence than he would have received absent application of the provision. Kim-ble now appeals from the district court’s sentence of seventy months incarceration for criminal contempt.
