—Judgment unanimously reversed on the law and indictment dismissed. Memorandum: Defendant was convicted of one count of intimidating a victim or witness in the third degree (Penal Law § 215.15 [1]). Defendant contends that the proof at trial is legally insufficient to establish his guilt. We agree.

The proof at trial establishes that defendant saw the *987confidential informant, seated in a police car, and shouted at him, "I see you, you f--g narc, you’re working with the police, you’re going to get yours.” The informant was then driven by a police officer to a parking lot, where they were…
