The record of this case shows that the plaintiff insured a certain boat-house and its contents in the sum of $500, under a policy of fire insurance issued by the defendant company, and that the property insured was destroyed by fire on September 23, 1914. On a suit upon the policy a nonsuit was granted. The errors complained of are: (1) that the court erred in granting a nonsuit; (2) that after the court had orally announced that a nonsuit was granted, the court erred in not permitting the plaintiff to again testify, and in not allowing plaintiff’s son to testify, as to the absolute refusal…
