Plaintiff MBIA Insurance Corporation (“MBIA”) has filed an amended complaint against the Federal Deposit Insurance Corporation (“FDIC”) asserting claims arising from the failure of IndyMac Bank, F.S.B. (“IndyMac Bank” or “IndyMac”) and its subsequent resolution by the FDIC. Defendant FDIC, in its capacity as receiver for IndyMac Federal Bank, F.S.B.
